RENTAL AGREEMENT

Morocco Adventure Campers Rental Agreement

Welcome to Morocco Adventure Campers!

This Rental Agreement outlines the terms for renting one of our fully equipped 4x4 camper vehicles. By booking and collecting the vehicle, you confirm that you have read, understood, and agree to these terms.

We're excited to help you explore Morocco — let's get into the details.

BOOKING DEPOSIT & PAYMENT TERMS

A deposit is payable at the time of booking to secure your vehicle for the requested dates. This deposit is deducted from the overall charges.

  • Bookings more than 6 weeks before start date: A deposit (typically 50% of the total) is authorized/held on your card at booking. The balance is due 6 weeks prior to the start date.
  • Bookings within 6 weeks of start date: Full payment is required at the time of booking.

In all cases:

  • The amount (deposit or full payment) is authorized/held on your credit/debit card but not fully charged until we review and approve your booking (including the post-deposit questionnaire).
  • If your booking is not approved (e.g., due to driver eligibility or other factors), the hold is released immediately and no charge is made.
  • Before paying/authorizing, you must read, understand, and accept this Rental Agreement and our Insurance. If you later fail to meet any requirements, you may forfeit the deposit/hold and be liable for other fees.

Payment must be by credit/debit card (no cash, no pre-paid cards). The card must be in the name of the main driver.

Prices are in US dollars, net of currency variances and bank charges.

CHARGES

You must pay the agreed rental charge and any other charges incurred during the rental period according to this Agreement, including:

  • the cost of any damage or loss to the vehicle or its equipment which was not noted on our pre-rental inspection and which is not covered by our insurance;
  • any other uninsured damage to, or loss of, the vehicle, the keys or its equipment;
  • the insurance excess (in the event of an insurance claim);
  • all parking fines, traffic violations and other charges incurred (we may charge an administration fee if we have to handle these on your behalf);
  • charges demanded lawfully by a third party as a result of the vehicle being parked or left upon land which is not a public road.

If necessary you consent to us notifying any authorities, organizations or enforcement agencies of your or any driver details, to effect a transfer of liability.

SECURITY DEPOSIT

You must lodge a $2,000 Security Deposit with us upon collection of the vehicle (at pickup). This deposit covers:

  • any damage, costs or losses (whether negligent, willful, accidental or otherwise) not covered by our insurance;
  • any additional charges, costs or losses you incur or are liable for whilst using the vehicle (e.g., the insurance excess, additional cleaning charges, fuel etc.).

The Security Deposit is fully refundable upon safe return of the vehicle in the same condition in which it was provided (fair wear and tear excepted, including all equipment).

The Security Deposit must be paid using a credit or debit card in the name of the main renter at the time of vehicle pickup. We do not accept cash security deposits.

  • If you use a credit card, the $2,000 amount will be pre-authorized (held) against your card. The funds are not charged immediately but are reserved and unavailable for spending until the hold is released after vehicle return and inspection.
  • If you use a debit card, we will charge the $2,000 and refund it in full (or the remaining balance after any deductions) after the post-rental inspection.

Should there be any damage, required repairs or replacements, or other reasonable costs, those amounts will be deducted from the Security Deposit before any balance is released or refunded to you. By entering into this Agreement, you authorize us to charge or deduct from the Security Deposit any amounts due. We reserve the right to retain the Security Deposit (or the pre-authorization) for a reasonable period necessary to fully assess and quantify any charges.

If the Security Deposit is insufficient to cover our uninsured or additional costs, charges, and losses, you remain liable for and must pay any outstanding amounts promptly.

We will always provide an itemized breakdown of any deductions and give you reasonable opportunity to review them.

RENTAL PERIOD

You have agreed to rent the vehicle for the period shown in your Reservation Confirmation. If you do not return the vehicle on time to the agreed return location you will be charged for every additional day or part-day.

Please note that unless agreed with us, unused rental days (or early returns) are non-refundable.

DRIVERS

Only one driver (the main driver named on the Rental Agreement) is permitted to operate the vehicle. No additional drivers are allowed.

The renter and main driver confirm that you:

i) are not under the age of 25 or over 75 years of age.
ii) have held a full valid driver's license (from any country) for a minimum of two years. An International Driving Permit (IDP) is recommended; you should check whether your country's driving license is accepted in Morocco without an IDP.
iii) have not had your license suspended for any period within the last three years.
iv) have not been involved in more than one fault incident within the last three years.
v) have no more than two convictions with a maximum of 3 points per conviction.
vi) have not obtained a disqualification for reckless/dangerous driving or theft/unauthorized taking.

COLLECTING THE VEHICLE

When you collect the vehicle you must complete:

  • a pre-rental inspection with us (this will include fixed equipment e.g. roof rack, roof tent, awning etc and the vehicle inventory e.g. table, chairs, stove, cutlery etc);
  • a short ‘orientation’ session so you are familiar with the vehicle (you must allow 60 minutes for this).
RETURNING THE VEHICLE

When you return the vehicle you must:

  • notify us if for any reason you cannot return the vehicle at the agreed time (you will not be covered on our insurance beyond any agreed return time);
  • ensure it is reasonably clean inside and out (our prices include standard cleaning upon vehicle return and additional cleaning charges may apply if return condition is poor);
  • All trash/recycling must be disposed of prior to returning the vehicle
  • hand the keys back to us personally (unless otherwise agreed in writing);
  • complete a post-rental inspection with us;
  • ensure it has a full tank of fuel (or pay our refueling charges).

If you return the vehicle outside of business hours you remain responsible for the vehicle and its equipment until a post-rental inspection is completed (which will be no more than 24 hours after you return the vehicle).

Some damage may not be apparent at the post-rental inspection, such as mechanical damage or damage hidden by adverse light or weather conditions. If we find any damage after you have returned the vehicle we will notify you as soon as we can.

FUEL

The vehicle will be supplied with a full tank of diesel fuel and should be returned to us with a full tank of diesel fuel. If you return it to us without a full tank of fuel, you will be liable to pay us for the fuel required to fill up the vehicle at our local garage, plus a fee of $30.

DRIVING AND USING THE VEHICLE

You must not:

  • allow any person other than the named main driver to operate the vehicle;
  • use the vehicle for hire, reward or driver training;
  • carry more passengers than the vehicle has seatbelts;
  • fit any additional equipment to the vehicle including racks or tow bar accessories unless agreed with us in advance;
  • apply any livery, branding, transfers or marks or paintwork to the vehicle;
  • drive the vehicle outside Morocco, unless we have given you written permission.
  • use the vehicle for racing, rallying, pace-making, speed testing, reliability trials, or any other competitive motorsport event (whether organized or informal);

You must:

  • use the vehicle within the limits of the law;
  • drive the vehicle only while sober and not under the influence of alcohol, drugs, medication, or any substance that impairs safe driving;
  • accept our right to refuse to rent a vehicle to any driver without providing a reason for our refusal.
PROHIBITED DRIVING ON SAND DUNES

For safety reasons, environmental protection, and to ensure insurance coverage remains valid, you are strictly prohibited from driving the vehicle on sand dunes.

Driving to, parking near, or exploring around sand dunes (e.g., Erg Chebbi or Erg Chigaga) is permitted and encouraged, as is driving on firm sandy tracks or pistes. However, absolutely no driving directly on the dunes themselves is allowed.

Our vehicles are fully equipped overland campers with rooftop tents and additional gear, making them heavier and more top-heavy than standard vehicles. This significantly increases the risk of rollover on sand dunes, which can result in serious injury or even death. Such incidents have occurred in Morocco's desert regions when drivers irresponsibly attempt to "joy ride" or drive on steep, unpredictable dune slopes, including cases involving tourists.

Any damage, loss, injury, or recovery costs resulting from driving on sand dunes will not be covered by our insurance, and you will be fully liable for all associated charges, including but not limited to repairs, towing, vehicle recovery (which can be extremely expensive and complex in remote desert areas), medical expenses, and any third-party claims.

Our vehicles are equipped with GPS trackers, and we reserve the right to remotely disable the vehicle if we detect or suspect a breach of this prohibition.

If you wish to experience riding directly on the dunes, local operators in areas like Merzouga offer guided quad bike or dune buggy excursions designed specifically for that purpose.

LOW-LEVEL OBJECTS

Our vehicles are equipped with roof racks, roof tents, tires, and other modifications that significantly increase the height of a standard vehicle to approximately 2.6 meters (before any additional customer-loaded items such as surfboards).

You must note the vehicle height at all times and be aware that the vehicles’ approach or departure angle may increase this height.

Parking garages and multi-storey car parks are strictly prohibited, as clearance is almost always insufficient in Morocco and damage to the vehicle (or the structure) is highly likely.

The fitted awning and any attached shower cube also add extra width to the vehicle. This additional width becomes particularly significant when the vehicle is angled (e.g., turning or parking on a slope), increasing the risk of contact with obstacles.

You are fully responsible for any damage to the vehicle caused by hitting any low-level object (such as parking garage barriers, bridges, low branches, or building overhangs) or by misjudging width due to the awning, shower cube, or angled positioning.

CHILDREN

We welcome families and allow up to three children (under 18 years of age) per vehicle.

Child Fee

An additional charge of $10 per day per child applies (maximum three children). This fee will be added to your booking total and is payable with the balance or at pickup, as applicable.

Included with the Child Fee

For each child, we provide:

  • a sleeping bag and pillow;
  • a child-sized camping chair;
  • access to a ground tent (upon request and subject to availability) for additional sleeping space;
  • a booster seat or child car seat (upon request and subject to availability).

Please specify the number, ages, and approximate weights/heights of your children at the time of booking so we can prepare the appropriate size car seats or boosters.

Sleeping Arrangements

Our vehicles have five seatbelts in total and the following sleeping options:

  • The lower bed (inside the cabin, approximately the width of a Toyota Hilux bed) is comfortably suitable for children up to approximately 150 cm (59 inches) in height. Up to two children of this size can sleep side-by-side in the lower bed.
  • The roof tent can accommodate the parents plus one additional small child.

This configuration works well for families with younger or smaller children. Children taller than 150 cm (59 inches) will likely find the lower bed too short for comfortable sleeping and should use the ground tent instead. We strongly recommend requesting a ground tent during booking if you have taller children.

All children must be secured using the provided seatbelts or the supplied child/booster seats in accordance with Moroccan road safety laws.

DOGS AND PETS

To maintain the condition of our vehicles and equipment for all customers, pets of any kind are not permitted in the vehicle or rental equipment.

This includes the vehicle cab, roof tent, ground tent, awning, and any other part of the rental setup. We regret that we cannot make exceptions, including for service animals or emotional support animals, as the vehicles are not equipped or insured to accommodate animals.

If evidence of a pet is found upon vehicle return (such as hair, odor, or minor damage), you will be responsible for:

  • specialized cleaning charges (minimum $500);
  • any necessary repairs or replacement of affected components; and
  • other reasonable associated costs.

These charges are not covered by our insurance and will be deducted from your Security Deposit or billed separately.

We appreciate your understanding and cooperation in helping us keep the vehicles in top condition.

SECURING LOADS AND TOWING

The vehicle is equipped with roof racks and tie-down points for carrying additional items (e.g., surfboards). We provide surfboard straps upon request — please let us know if you need them.

All loads must be securely fastened using the provided equipment. You are fully responsible for any damage caused by an unsecured or shifting load (not covered by insurance).

The fitted recovery/tow hook is for emergency recovery only (e.g., if the vehicle is stuck or to assist another stuck vehicle at low speed). General towing (trailers, caravans, etc.) is strictly prohibited.

Any damage resulting from improper use of the recovery hook is your responsibility and not covered by insurance.

ROOF AND GROUND TENTS

If your vehicle is equipped with a roof or ground tent:

  • ensure that you close and secure the roof tent before driving;
  • in the event of a thunderstorm with nearby lightning, for added safety, move to shelter inside the vehicle cab;
  • smoking, vaping or naked flames are not allowed in any part of the vehicle, roof tent, ground tent or awning.
COOKING

You must only use the cooking equipment supplied with the vehicle if you are confident and competent in their use and:

  • you must NEVER use the cooking equipment inside the vehicle, roof tent, ground tent or an enclosed awning;
  • if you decide to cook under cover of any kind you must ensure:
  • there is adequate ventilation, head height and distance to the vehicle and accessories;
  • you are alert to the risk of fire and the possible build-up of carbon dioxide (or worse, carbon monoxide);
  • you must ensure that you have easy access to the fire extinguisher/blanket supplied with your vehicle.
DRIVING SURFACES AND ‘OFF-ROAD’ DRIVING
  • Under all circumstances you understand that our insurance does not cover damage or loss of any kind whilst driving ‘off road’ (i.e., not on a sealed public highway or designated piste).
  • If you drive ‘off road’ intentionally or unintentionally, you agree that any resulting damage, excess wear and tear, injury, or loss is your full responsibility.

Moroccan pistes and unsealed tracks are a core part of the overland experience and are permitted, provided you drive responsibly and within your skill level.

Prohibited Routes

Certain notoriously technical or high-risk tracks are strictly prohibited due to extreme difficulty and high likelihood of vehicle damage or becoming stuck. Examples include, but are not limited to, the Cirque de Jaafar and similar challenging routes.

Sand Dunes

Driving on sand dunes is strictly prohibited at all times. Please refer to the "Prohibited Driving on Sand Dunes" section for details.

Water Crossings

Driving the vehicle into salt water (including the ocean, beaches, salt lakes, or salt flats) is strictly prohibited due to severe and rapid corrosion risks.

Fresh water crossings (such as shallow rivers, puddles, or minor floods on pistes) are permitted but require caution. Avoid deep or fast-flowing water at all times.

Note on Snorkel: The raised air intake (snorkel) is fitted primarily to protect the engine from dust ingestion in desert conditions. It is not designed or intended to allow deep water crossings. Do not interpret its presence as permission or capability for deep wading.

You are fully responsible for any damage resulting from water ingress or corrosion. Salt water damage is not covered by our insurance.

Weather and Track Conditions

Pistes and overland tracks can change rapidly, especially after rain. Flash floods, washouts, deep sand, or mud can make even familiar routes impassable.

You are responsible for monitoring weather forecasts and current track conditions. If a piste becomes affected by rain, flooding, or deterioration, you must assess the situation carefully and turn around if it is unsafe to proceed. Continuing in poor conditions can lead to the vehicle becoming stuck or damaged, for which you will be fully liable (including all recovery costs, which can be substantial in remote areas).

IMPORTANT: You must not drive the vehicle extensively off legal roads or designated pistes unless expressly agreed in writing in advance.

IMPORTANT: It is illegal to drive a motor vehicle on private land or any land that is not forming part of a road without authorization.

Please be aware that our vehicles are equipped with GPS tracker devices that live track and record their movements. We reserve the right to remotely disable the vehicle in the event of a serious breach of this Agreement.

DESERT SAFETY

Morocco's desert regions offer incredible experiences, but they also present unique risks. You are responsible for your own safety and must exercise caution at all times.

Key desert safety guidelines:

  • Carry sufficient water (at least 4 liters per person per day) and non-perishable food in case of delays or breakdowns.
  • Inform us or a trusted contact of your planned route and expected return time when venturing into remote areas.
  • Check weather forecasts – flash floods can occur suddenly, even in dry areas.
  • Drive slowly on sandy or gravel surfaces to maintain control and reduce tire damage.
  • Reduce tire pressure slightly (as guided during orientation) for better traction on soft sand, but reinflate for paved roads.
  • Never drive alone in extremely remote areas if possible; consider traveling in convoy.
  • Carry a fully charged phone with a local SIM, a portable charger, and emergency numbers (police: 19, gendarmes: 177).
  • Be aware of extreme temperature changes – hot days and cold nights.
  • In case of getting stuck in sand, do not spin the wheels excessively; use recovery techniques demonstrated during vehicle orientation or call for assistance.

Failure to follow reasonable safety practices may result in uncovered costs under our insurance.

TIRE PRESSURE MANAGEMENT

Proper tire pressure is essential for safety, vehicle performance, and preventing damage, especially on varied Moroccan terrain.

You are responsible for monitoring and adjusting tire pressure according to the terrain you are driving on. We will demonstrate how to use the onboard air compressor and tire pressure gauge during your vehicle orientation session, and provide recommended guidelines.

Recommended tire pressures:

  • Asphalt/paved roads: 35 psi front, 42 psi rear
  • Dirt, gravel, or rocky terrain: 25 psi all tires
  • Sand/soft sandy tracks: 18 psi all tires

Always "air down" (reduce pressure) before entering softer or rougher terrain to improve traction and reduce the risk of getting stuck or damaging tires. Re-inflate ("air up") to the appropriate higher pressure as soon as you return to firmer surfaces to ensure safe handling, fuel efficiency, and to prevent tire wear or blowouts.

Failure to properly manage tire pressure may result in tire damage, reduced vehicle control, or getting stuck, for which you will be fully responsible (including any recovery or repair costs). Such damage is not covered under standard insurance if deemed to result from improper use.

TIRES / WINDSHIELD

In the event of a puncture or damage to tires or windshield, you are liable for the cost of repair or replacement.

In the event that a tire or windshield is returned damaged at the end of your rental, it will be at our discretion whether to repair or replace it, taking into account legal and safety requirements.

If you have a puncture or cracked windshield during your rental, you may use any reputable garage to replace the tire or windshield with ones of equivalent specification and quality.

You will arrange for the tire or windshield to be repaired or replaced as soon as possible after the incident.

CARE OF THE VEHICLE AND EQUIPMENT

You must:

  • treat the vehicle and its equipment with care and respect;
  • take all reasonable steps to maintain the vehicle;
  • contact us if you become aware of a fault;
  • notify us of any damage caused to the vehicle;
  • not let anyone work on the vehicle without our permission;
  • protect the vehicle and its equipment against weather or other environmental conditions which might cause damage (e.g. wind damage resulting from the awning being deployed, or leaving the vehicle windows open when it rains);
  • not allow smoking or vaping in the vehicle, roof tent, awning or any ground tents we rent to you;
  • seek our guidance if you are uncertain about the use of any part of the vehicle or its equipment.
SECURITY OF THE VEHICLE

You must:

  • lock the vehicle when you are not using it;
  • take the keys out of the ignition when you are not in the vehicle and keep them with you;
  • use any security device provided;
  • do not leave vehicle equipment, accessories or your own belongings on display;
  • ensure that the vehicle equipment and accessories are secure using all locks and padlocks.

To maintain and protect the vehicle we may fit and use electronic devices to monitor its condition, performance and operation and/or to live track its movements. This data may be used both during and after termination of the rental period, including to enforce prohibitions such as driving on sand dunes. A condition of rental is that you consent to the use of such devices, and to the collation, storing and use of the information arising from them.

We reserve the right to remotely disable the vehicle if necessary to prevent or mitigate a breach of this Agreement.

MILEAGE

There is no mileage limit or surcharge for the duration of your rental.

You may drive as many kilometers as you wish during the Rental Period without additional mileage fees.

Please note that excessive wear and tear beyond normal use (as determined at our discretion during the post-rental inspection) may still result in additional charges.

OUR RESPONSIBILITIES

We assure you that:

  • the vehicle has been maintained to roadworthy and legal standards;
  • the vehicle and its equipment are suitable and safe for rental at the start of the rental period;
  • we will disclose any known existing damage or defects before you take the vehicle.

Our liability is limited as follows:

  • We are responsible for death or personal injury caused by our negligence.
  • We are responsible for loss or damage to your personal property left in the vehicle only if caused directly by our negligence or breach of contract.
  • We are not responsible for any indirect, consequential, or economic losses (such as missed flights, accommodation costs, loss of enjoyment, or loss of opportunity).

If the booked vehicle becomes unavailable due to unforeseen circumstances, we will provide a suitable alternative if possible. If no alternative is available, our liability is limited to a full refund of monies paid to us.

OUR INSURANCE

Our rental charges include the provision of vehicle insurance provided to us by Wafa Assurance. We will have provided you with full details of our insurance policy separately. Please ask us if you have any questions regarding the extent of the cover provided.

By entering into this Agreement you confirm that you have read, understood, and are accepting the Conditions of our insurance.

Please note that although termed ‘comprehensive’ our insurance does NOT give you complete cover, for example:

  • one amount for which you are not covered is called the “excess” which is $1,000;
  • you are responsible for all costs incurred through your own negligence;
  • your own property is not covered by our insurance.

You may decide to take out separate insurance to cover aspects of your rental that are not covered by our insurance.

IN THE EVENT OF AN ACCIDENT

You must:

  • notify the police;
  • get the names and addresses of everyone involved, including witnesses;
  • note the registration numbers, make and model of the vehicles involved;
  • obtain details of the insurers of any third parties;
  • if possible and appropriate, photograph the scene, the vehicles and damage;
  • make the vehicle secure;
  • notify Morocco Adventure Campers as soon as is practical.

We will ask you to complete an accident report form. Failure to provide third party details and a completed accident report form may result in liability for double the standard excess.

In the event that the vehicle cannot be driven after an accident, a replacement or substitute vehicle is not assured.

For the avoidance of doubt, you accept that we will not be liable to pay any compensation or cover other losses or expenses as a result of an accident, subject otherwise to the terms, exceptions and conditions of this Rental Agreement and our Conditions of Insurance.

BREAKDOWN

In the event of a breakdown you should consult the Vehicle User Guide and contact the breakdown service using the numbers provided and quote the car registration number as a reference:

  • if the vehicle cannot be repaired, a replacement or substitute vehicle from Morocco Adventure Campers is not assured;
  • You are authorized to approve essential repairs up to a total cost of $150. All receipts must be provided in respect of any such repairs before any such costs can be reimbursed;
  • You, not us, will be liable for the cost of any repairs, or other costs, resulting from reckless, negligent or imprudent use of the Vehicle by you or permitted by you including, for the avoidance of doubt, but not limited to the cost of towage, recovery, replacement Vehicle, equipment and/or car rental
  • You will notify us by telephone of the breakdown as soon as possible in order to give us the opportunity to rectify the problem during the rental period.
  • If the repair cannot be completed within 24 hours, and it is not the result of reckless, negligent or imprudent use of the Vehicle by you or permitted by you, we will endeavor to help you by providing a replacement Vehicle (if available). If your Vehicle cannot be repaired within 24 hours and a replacement Vehicle is not available, we will refund you the Rental Charge paid in respect of the remainder of the Rental Period. We are not responsible for any costs you have or may subsequently incur as a result of any such cancellation. This includes, but is not limited to, the cost of flights, ferries, fuel, hotels etc.

By entering into this Rental Agreement you accept that if the vehicle breaks down that our liability extends to either:

  • replacing your vehicle with a similar one, if available, or;
  • refunding your rental charge for any days you lose use of the vehicle.

For the avoidance of doubt, you accept that we will not be liable to pay any compensation or cover other costs, losses or expenses resulting from a breakdown (subject otherwise to the terms, exceptions and conditions of this Rental Agreement, our vehicle Insurance, and our Breakdown Policy).

You may wish to consider taking out separate travel insurance to cover you for any additional costs incurred in the event of a breakdown.

STOLEN VEHICLE

In the event of the vehicle being stolen the first thing you must do is contact the Police and report the theft. Please then contact Morocco Adventure Campers directly as the vehicle may be fitted with a tracking device that allows us to assist in its recovery.

DATA PROTECTION

By entering into this Rental Agreement you agree that we can process and store your personal information in connection with this Agreement including data collected from the vehicle. We may use your information to analyze statistics, credit control and to protect our assets.

You agree that if you break the terms of this agreement we can pass your personal information to credit-reference agencies, debt collectors, the police or any other relevant organization. We can also give this information to relevant industry associations, which can share your personal information with its members to prevent crime and protect their assets, as allowed under applicable data protection laws.

CANCELLATION OR TERMINATION

You may cancel your booking at any time by giving notice in writing, by e-mail, or by phone which will take effect on the date we acknowledge it to you.

In the event of a cancellation or termination, one of the following applies:

  • 90 days or more prior to the Rental Period: Full Refund
  • Between 89 and 42 days prior to the Rental Period: 50% Refund
  • Less than 42 days prior to the Rental Period: No Refund

Any entitlement to a refund less than 90 days prior to the rental period is subject to a Booking Fee of $300.

Before you enter into this Agreement you may wish to consider taking out separate travel insurance to cover you for costs incurred in the event of a cancellation.

ENDING THE AGREEMENT
We are entitled to terminate this Agreement if you break its terms and you must then return the vehicle immediately. If the Agreement is terminated we may repossess the vehicle and any associated costs must be paid by you.
